# FixersTech School Terms of Service **Effective Date:** October 1, 2026 **Version:** 1.0.0 These Terms of Service ("Terms") constitute a legally binding agreement between FixersTech ("Provider", "we", or "us") and the educational institution or subscriber ("School", "Customer", or "you") accessing the FixersTech School platform. ### 1. Acceptance & Authority By registering an account, submitting an onboarding application, or accessing the FixersTech platform, you represent and warrant that you have full legal authority to bind your educational institution to these Terms. ### 2. Institutional Account & Administration - **Administrative Authority:** The designated School Administrator is responsible for managing staff, teacher, student, and parent user permissions within their tenant account. - **Credential Confidentiality:** Each user must maintain the confidentiality of their credentials. The School is responsible for all activity conducted under its tenant user accounts. - **Accurate Information:** The School agrees to provide accurate, up-to-date institutional and contact information during registration and ongoing operations. ### 3. Subscription Plans, Billing & Renewals - **Subscription Tiers:** FixersTech provides Free, Basic, Balanced, Ultimate, and Enterprise tiers. Features, student limits, branch allocations, and user capacities are defined by the active subscription plan. - **Free Plan Rules:** Under our established Free tier policy, eligible institutions may use the Free Plan for up to six (6) calendar months or until enrolled students reach the 100-student threshold, whichever provides the longer operational period (`WHICHEVER_LATER`). Upon expiration, the institution may upgrade to an active paid plan. - **Billing Cycles:** Paid subscriptions are billed on a monthly or annual basis as selected upon registration. Annual plans receive a discounted rate equivalent to ten (10) months of monthly service (2 months free). - **Plan Limits:** If institutional usage exceeds plan thresholds (such as student count or branch limits), the platform will notify administrators to upgrade to an appropriate tier. ### 4. Customer Data & Intellectual Property - **Ownership of School Data:** The School retains sole and exclusive ownership of all student records, academic curricula, staff documentation, and financial transaction records entered into the platform. - **Platform Ownership:** FixersTech retains all right, title, and intellectual property in and to the platform software, user interface design, APIs, databases, documentation, and underlying code. ### 5. Acceptable Use The Customer agrees not to: - Attempt to bypass tenant security boundaries, access records of another school, or test platform security without written authorization. - Use the platform to distribute unsolicited commercial communications (spam) or malicious files. - Resell, sublicense, or rent platform access to unauthorized third parties. ### 6. Service Availability & Support We make commercially reasonable efforts to ensure reliable platform availability (targeting standard 99.5% operational uptime for web services, excluding scheduled maintenance windows). Standard technical support is provided via email and ticket desk, with priority escalation for Balanced and Ultimate tiers. ### 7. Limitation of Liability To the maximum extent permitted by applicable law, FixersTech shall not be liable for indirect, incidental, special, or consequential damages resulting from lost school profits, educational disruption, or business interruption. Total liability under any claim arising from these Terms shall be limited to the fees paid by the Customer in the twelve (12) months preceding the incident. ### 8. Governing Law These Terms shall be governed by and construed in accordance with the laws of the Islamic Republic of Pakistan, subject to the jurisdiction of the competent courts in Lahore, without prejudice to mandatory local consumer protections where applicable.
